If you are in Canada and your situation is especially difficult, a Humanitarian and Compassionate (H&C) application may be a possible, but exceptional, pathway to permanent residence. This type of application is meant to be a last resort, when someone does not qualify under regular immigration programs, and there are strong, compelling personal reasons to stay in Canada.
We help you understand whether this may be a realistic option and how to present your situation honestly, respectfully, and with clear evidence.
Who this service is for
This service is for:
- People who are already in Canada and have serious, exceptional circumstances that make it hard to leave.
- Individuals who may not qualify for Express Entry, Family Sponsorship, study, or work permits and are looking for a rare alternative.
- Families, children, or individuals facing health, safety, family hardship, or other special factors.
- People who want honest, realistic guidance about whether an H&C application is appropriate for their situation.
I will not encourage you to apply just because you have “no other option.” Instead, I will help you see if your case meets the high bar that H&C deserves.
What is an H&C application?
A Humanitarian and Compassionate application is a request for permanent residence based on exceptional and compelling personal circumstances. It is not a standard immigration pathway and is not guaranteed. IRCC considers factors like:
- How long you have lived in Canada and how well you are integrated.
- Your family ties, especially the best interests of any children.
- Health, personal hardship, safety or protection concerns.
- Your work, community involvement, and level of establishment in Canada.
Because H&C is highly discretionary, each case is reviewed on its own merits. It is not a general “back‑door” to PR and should be considered carefully, only when truly exceptional circumstances apply.
How the process works:
- We review your situation realistically
- First, we look at your background, your time in Canada, and your personal circumstances. If your situation does not meet the high H&C standard, I will tell you that honestly and suggest other options that may be more realistic for you.
- We gather strong, thoughtful evidence
- If your case may be exceptional enough for H&C, we help you collect documents that show your ties, hardship, family situation, and any special risks you may face if you must leave Canada. This may include school or work records, medical reports, letters from family or professionals, and community support.
- We prepare the application carefully
- The H&C application needs to tell a clear, honest, compassionate story that shows why your case is truly exceptional. I help you present your situation in a respectful, well‑organized way without exaggeration.
- We submit and follow up
- Once the application is submitted, IRCC usually takes a long time to review it and may request additional information. If they do, I will help you respond thoughtfully and on time. At every stage, I will help you stay informed and manage your expectations.
Key things to know:
- H&C is for permanent residence from within Canada in exceptional cases only.
- It is not a regular immigration stream and should be seen as a last resort, not a first option.
- The decision is highly discretionary, so approval is never guaranteed.
- Strong, credible evidence and a clear, honest explanation are essential.
- The best interests of a child can be a very important factor when children are affected.
